Contract Dispute Resolution in Saudi Arabia

How to move from disagreement to a structured, evidence-led resolution.

A contract dispute is easier to manage when the parties understand the issue before choosing the forum. In Saudi construction and commercial work, the contract, project records, governing law, and dispute clause should be reviewed together.

Start with the dispute map

Define the issue in one sentence, identify the relevant clause, and list the remedy sought. Common categories include payment, delay, extensions of time, defective work, scope changes, termination, and liability allocation.

Use evidence as the centre of the strategy

Organise the contract, amendments, notices, meeting minutes, instructions, programme records, invoices, technical reports, and correspondence in a chronology. A strong chronology can reveal whether the dispute is legal, factual, valuation-based, or a combination of all three.

Choose the right resolution path

Negotiation can preserve a commercial relationship when the parties have enough information to compromise intelligently. If negotiation fails, follow the contract’s escalation process and assess whether arbitration or the Saudi commercial courts is the appropriate route.

Prepare for the cost of delay

Preserve rights while discussions continue. Missed notices, incomplete records, and unclear settlement language can create avoidable risk. A written position paper that separates facts, entitlement, quantum, and requested action often helps the business make a faster decision.
